Un­civil, Il­le­gal and Un­law­ful 1989 Or­der of KPS Gill

This ar­ti­cle is for the Doubt­ing Thomasses. This is just one sam­ple of the many pieces of ev­i­dence which were pre­sented to In­dian courts one af­ter an­other only to be ei­ther set aside or sim­ply ig­nored. Some­day, when Sikhs are able to set their own Nurem­berg type tri­als, KPS Gill will be tried, even if posthu­mously.

If any­one has any doubts about the bar­baric, il­le­gal and un­law­ful na­ture of work done by KPS Gill, read this. Delhi-based hu­man rights lawyer Tejin­der Singh, in an af­fi­davit which the Pun­jab po­lice filed in a case of in­vol­un­tary dis­ap­pear­ance, ac­ci­den­tally stum­bled upon this 1989 or­der of KPS Gill which en­lists 53 in­sur­gents, whom the po­lice called ter­ror­ists and which di­rects the dis­trict po­lice chiefs to kill them for a prize money men­tioned against their names.

Shocked at the writ­ten or­der ask­ing the dis­trict po­lice chiefs to kill them for prize money with­out fol­low­ing any due process, the or­der was chal­lenged in the High Court of Pun­jab and Haryana. Cor­nered, the gov­ern­ment of Pun­jab, af­ter dilly dal­ly­ing in the courts sub­mit­ted an­other doc­u­ment in which the or­der was liq­ui­da­tion was re­moved but the list was main­tained.

Sig­nif­i­cantly, af­ter a cou­ple of hear­ings, the Pun­jab and Haryana High Court ac­cepted the sub­mis­sion of the po­lice and the State of Pun­jab with­out any puni­tive re­marks or judge­ment against the po­lice chief.

Even in tin pot lit­tle African coun­tries they have the cam­ou­flage of be­ing right on the right side of law. Nowhere does on so brazenly ask or or­der sub­or­di­nate of­fi­cers to kill peo­ple and in no civ­i­lized coun­try would such an or­der not at­tract no pun­ish­ment to those who is­sued it.

The strug­gling Sikh youth took it in their stride. They were not par­tic­u­larly shocked be­cause this has hap­pened with the Sikhs in his­tory. The Mughal rulers, like the pre­sent rulers too had fixed a price for Sikh heads and the Mughal army would kill Sikhs and take money from their chief­tains.

In its re­port en­ti­tled, Pun­jab Po­lice: Be­yond the Bounds of the law pub­lished in May 1995, in­ter­na­tion­ally renowned hu­man rights body, Amnesty In­ter­na­tional says, “Amnesty In­ter­na­tional is con­cerned at a pat­tern of hu­man rights vi­o­la­tions com­mit­ted by of­fi­cers of the Pun­jab po­lice act­ing out­side their home state. There have been a se­ries of in­ci­dents in re­cent years in which Pun­jab po­lice have trans­gressed their op­er­a­tional ju­ris­dic­tion, trav­el­ling, of­ten in ve­hi­cles with­out num­ber plates, to other In­dian states to carry out un­der-cover op­er­a­tions which re­sulted in se­ri­ous hu­man rights vi­o­la­tions. These in­cluded ab­duct­ing wanted Sikh sus­pects who have sub­se­quently “dis­ap­peared” or been killed in cus­tody.

Re­ports in­di­cate that the Pun­jab po­lice have been con­duct­ing such op­er­a­tions in states other than Pun­jab with­out seek­ing per­mis­sion of the au­thor­i­ties of the states con­cerned or giv­ing them prior in­for­ma­tion about their ac­tions. This is il­le­gal ac­cord­ing to the Con­sti­tu­tion of In­dia: the re­spon­si­bil­ity for the main­te­nance of pub­lic or­der within the ter­ri­tory of a state and for the po­lice rests ex­clu­sively with the state gov­ern­ment con­cerned. As far as Amnesty In­ter­na­tional is aware, lit­tle progress has been made in in­ves­ti­ga­tions or­dered into these al­le­ga­tions and in the ma­jor­ity of the cases those re­spon­si­ble have not been brought to jus­tice.”

As re­ported by Amnesty In­ter­na­tional, when asked to com­ment on al­le­ga­tions of in­vol­un­tary dis­ap­pear­ances in Lon­don, KPS Gill said, “that al­le­ga­tions of “dis­ap­pear­ances” were en­tirely un­founded since they con­cerned young men who had left the coun­try and were liv­ing abroad.” Who does not know that hun­dreds had to flee the coun­try to save their own lives and that of their fam­i­lies as they were be­ing hounded by KPS Gill and his men.
